Not sure if this is the solution or not, but once I got the message that this would not open I did the following in this order. Restore License for PS5. Rebuilt Data Base of PS5. Ejected disc, put disc back in, and reinstalled. It has now turned off and on still working. If someone wants to try this and it works I will pass this along to others. Based on my case above: Go to the PS5 Video Output Settings and set the resolution from AUTO to 2160p Then go to „Enable 120Hz output“ and turn this from Auto to OFF. Now COD MW2/3 will start normally in 4k HDR 60Hz. of course, as usual this is a problem Activision caused. Not a single other game has this problem.

Things I've tried that haven't worked; • Setting video output to 1080p (thought that maybe the PlayStation might be encountering errors when downgrading the video output for 1 game.) • Turning off the improved texture download. (thought maybe it was causing the game to stutter.)

There might be an open beta patch that was released. To fix the issue of Modern Warfare 3 not launching on PlayStation 5, make sure the game is up to date with the latest version. Press the options button on your controller, select the game, and then choose "check for updates." If there's a new version, download it. It worked for me, just so you know! So from the ps5 home menu, settings cog in the top right. Storage > console storage (or whatever drive you have it on) > saved data > ps5 > delete > call of duty modern warfare 2. Deleting that will erase all campaign progress, and game settings. You’ll still have all your weapon configs and player configs 2MDqGcz.
